Landlords and their agents have the following statutory duties:

 

  • They must ensure the maintenance of all commercial gas appliances, fittings, and flues in a safe condition. This means they should regularly commission a Gas Safe engineer to service all gas installations and appliances and keep a record of the gas services performed.
  • They must ensure a commercial safety check on all gas appliances and flues annually, or before the start of a new tenancy, is done.
  • They must check commercial gas installations and appliances before starting a new tenancy, regardless of whether a safety certificate is current.
  • All installation, maintenance, and safety checks must be carried out by a Gas Safe registered engineer only.
  • They must keep a record of each commercial gas safety check for 2 years, which will be issued by the registered Gas Safe gas installer/inspector.
  • They must provide each current tenant with a copy of the Gas Safe installer’s safety check report within 28 days of the safety check or provide it to new tenants before occupation.
